Website Terms & Conditions of Sale

Effective date: 18 August 2026

1. Introduction

These Terms and Conditions (‘Terms’) govern your use of the website www.cleverproducts.co.za (‘the Website’) and any purchase made through it. The Website is owned and operated by Clever Products (‘we’, ‘us’, ‘our’), a small, family-run business based in South Africa, registration number K2026383604, with its registered/trading address at 44 Leeu Street, Rant-en-Dal, Krugersdorp, 1739.

By browsing, registering, or placing an order on the Website, you (‘you’, ‘the customer’, ‘the user’) agree to be bound by these Terms, our Returns & Refunds Policy, and our Privacy Policy. If you do not agree, please do not use the Website.

These Terms are governed by the laws of the Republic of South Africa, including the Consumer Protection Act 68 of 2008 (‘CPA’), the Electronic Communications and Transactions Act 25 of 2002 (‘ECTA’), and the Protection of Personal Information Act 4 of 2013 (‘POPIA’).

2. Who We Are

We sell educational toys, games, art and craft supplies, and bulk snacks. We are a small, family-run business. We do not hold large stock volumes; instead, we order from our suppliers on a weekly to biweekly basis in order to keep our costs — and therefore our prices — low.

3. Placing an Order

  • Orders may be placed through the Website by selecting products, adding them to your cart, and completing the checkout process.
  • By placing an order, you make an offer to purchase the selected goods subject to these Terms. We reserve the right to accept or decline any order at our discretion (for example, in cases of stock unavailability, supplier pricing errors, or suspected fraud).
  • Payment for your order is taken in full at checkout, including the standard R125 delivery fee. You will receive an order confirmation via email once your order and payment have been received (see Section 5 for details on additional freight, where applicable).
  • You are responsible for ensuring that the information you provide (delivery address, contact details, product selection) is accurate and complete.

4. Pricing

  • All prices displayed on the Website are quoted in South African Rand (ZAR). Clever Products is not currently a VAT-registered vendor, and VAT is not charged on any products or services.
  • Prices exclude the standard R125 delivery charge, which is added and paid at checkout. Any additional freight charge (see Sections 5 and 6.2) is calculated and communicated separately.
  • We make every effort to ensure prices displayed are accurate. In the event of a genuine pricing error, we reserve the right to cancel the order and issue a full refund, or to contact you to confirm whether you wish to proceed at the correct price.
  • We reserve the right to change prices at any time, but changes will not affect orders already confirmed and invoiced.

5. Payment, Order Processing & Additional Freight

Payment for your order (including the standard R125 delivery fee) is made in full at checkout, at the time you place your order. Once your order and payment have been received, the following process applies:

  • We will place your order with our supplier(s).
  • We will keep you updated on the progress of your order, including any changes to stock availability.
  • Because we do not hold large amounts of stock and order from suppliers as needed, some orders may incur a delivery cost higher than the standard R125 (for example, due to weight or delivery location). Where this is the case, we will inform you of the additional freight amount promptly upon receiving your order and before we begin processing it, so you know what to expect.
  • Once your order has been received from our supplier(s) and is packed and ready for dispatch, we will send you an invoice for the additional freight amount (if applicable). This must be paid before your order is dispatched.
  • Accepted payment methods at checkout are: credit/debit card, instant EFT via PayFast
  • Where an additional freight invoice applies, this amount is payable via direct EFT into our business bank account. Our banking details will be provided together with the additional freight invoice.
  • Where additional freight applies, your order will only be dispatched once this additional amount has been paid and reflects in our bank account.

Please note: we will never change our banking details via email without prior confirmation through a verified phone number. If you receive banking details that seem unexpected or unusual, please contact us directly to confirm before making payment, to protect against email/invoice fraud.

This process allows us to charge accurately for freight on heavier or harder-to-reach orders, rather than passing on unpredictable courier costs to all customers through higher standard delivery fees.

6. Delivery

6.1 Delivery Times

As a small business that orders stock as needed rather than holding large inventory, please allow between 5 and 20 working days for delivery, from the date your order is confirmed and paid for. We will endeavour to keep you informed of your order’s progress.

6.2 Delivery Charges

  • A standard delivery fee of R125 applies to most orders and is charged and paid at checkout.
  • Where a delivery is significantly heavier, bulkier, or destined for a location that incurs higher freight costs, an additional delivery charge may apply over and above the standard R125 fee.
  • Should this be the case, we will inform you of the additional amount promptly upon receiving your order and before we begin processing it. An invoice for this additional freight amount will follow once your order is packed and ready for dispatch, and must be paid before dispatch (see Section 5 for full details).

6.3 Delivery Area

We currently deliver only within South Africa.

6.4 Risk & Ownership

Ownership of goods passes to you once payment has been received in full. Risk in the goods (i.e., responsibility for loss or damage) passes to you upon delivery to the address provided by you.

7. Stock Availability

Because we order stock from suppliers on a weekly/biweekly basis rather than holding large inventory, there is a possibility that an item may become unavailable after you have placed and paid for your order. We will keep you updated on your order’s progress and will contact you as soon as possible if any stock changes or unavailability arise, to offer a substitute, a refund for that item, or the option to wait for restocking, at your choice.

8. Returns, Refunds & Faulty Goods

Our full Returns & Refunds Policy applies to all purchases made through the Website and is available at https://cleverproducts.co.za/shipping-details/. In summary:

  • Faulty, defective, or damaged goods may be returned within 7 days of delivery for a repair, replacement, or refund, in accordance with Section 56 of the CPA.
  • Unopened, sealed food/snack items may be returned within 7 days; opened food items cannot be returned for hygiene and safety reasons.
  • Change-of-mind returns are considered on a case-by-case basis and are not guaranteed.
  • This does not affect your statutory rights under the CPA.

9. Online/Distance Sales — Cooling-Off Rights

In terms of Section 44 of the ECTA, where goods are purchased online as part of a once-off electronic transaction (rather than an ongoing subscription), you may be entitled to cancel the transaction within 7 (seven) days of receiving the goods, without reason or penalty, subject to the conditions of the ECTA. This right does not apply to goods made to your specification, perishable goods (including opened food/snack items), or goods which by their nature cannot be returned. Please refer to our Returns & Refunds Policy for full details.

10. Product Descriptions & Images

We make every effort to ensure that product descriptions, images, and specifications on the Website are accurate. However, slight variations in colour, packaging, or design may occur due to supplier changes, screen display settings, or manufacturing updates. These variations do not constitute a defect.

Age recommendations and safety warnings on toys and craft supplies should always be followed. Please supervise children when using art, craft, or small-parts products.

11. Limitation of Liability

  • To the extent permitted by law, we shall not be liable for any indirect, incidental, or consequential loss or damage arising from the use of, or inability to use, the Website or products purchased through it.
  • Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under the CPA, including liability for goods that are unsafe, defective, or hazardous.
  • We are not liable for delays caused by circumstances beyond our reasonable control, including but not limited to supplier delays, courier delays, load shedding, strikes, or force majeure events.

12. Website Use & Intellectual Property

  • All content on the Website — including text, images, logos, and design — is the property of Clever Products or its licensors and may not be copied, reproduced, or used without our written permission.
  • You agree not to use the Website for any unlawful purpose or in any way that may damage, disable, or impair the Website.

13. Privacy

Any personal information collected through the Website (for account creation, checkout, or communication) is handled in accordance with our Privacy Policy, which forms part of these Terms and is available at https://cleverproducts.co.za/privacy-policy/.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes in our business, pricing, or legal requirements. The version in effect at the time you place an order will apply to that order. We encourage you to review this page periodically.
